I request permission to ride as a guest of the Greenway Trust, in a vehicle owned by the Greenway Trust on the date of August 19, 2023.To utilize the Bikes & Bru’s shuttle service, each individual must submit a completed version of this waiver and release form. Participants who register for multiple shuttle timeslots must sign a separate waiver for each ride. An individual without a signed Waiver and Release will not be permitted to participate in the shuttle.

In consideration of my registration to utilize this shuttle service and by signing this Waiver and Release, I agree to the following terms:

  1. Assumption of Vehicular Risks: I understand that should permission be granted, I will be riding totally at my own risk and I am willing to assume all risks involved including the risk of death or serious injury. I acknowledge that any permission granted to me may be revoked at any time for any reason without prior notice. This waiver does not revoke my right to be able to put claim damages against a third party that caused an incident that injured me or caused me damage while riding in the Greenway Trust vehicle, but it does hold harmless the Greenway Trust unless it is the Greenway Trust’s sole negligence. I will wear my seatbelt at all times while in the vehicle and observe safe passenger behavior practices and not distract the driver
  2. Assumption of Risks: I am aware that participation in these activities poses certain inherent dangers, including but not limited to the risk of serious physical injury or death, hazards of accidents, hazards of travelling in mountainous terrain, exposure to environmental dangers, animal/insect bites or stings, contact with poisonous plants, and actions of participants and other persons. By my participation, I certify that I am aware of these inherent risks, and I agree to follow all applicable laws and safe practices.
  3. Medical Care Authorization: I certify that I am physically able to participate in this activity. I hereby consent to emergency medical treatment if I am injured while participating, and I accept full responsibility for all medical expenses incurred as a result of my participation.
  4. Release and Indemnification:  In consideration for granting my request to ride as a passenger in a vehicle owned by the Greenway Trust, and being fully aware of the risks involved, I hereby release from any liability, and agree to hold harmless and indemnify Mountains to Sound Greenway Trust, its employees, officers, agents, successors, and assigns, or other volunteers from any claims brought by me or on my behalf, including injury, loss, or damage caused by the negligence, unintentional acts, and acts of omission of any party, and any loss or expense, which may arise from my participation in this activity. Being fully aware as to these inherent risks and in consideration of the privilege of riding along in a Greenway Trust vehicle, I hereby assume all risk of liability for injury, loss, death, damage, or other consequences.  This Waiver and Release is intended to be binding upon me, my family, my heirs, my estate, my legal representatives, and assigns, except those arising except for injuries and damages caused by the sole negligence of the Greenway Trust. Any legal action that may arise from my participation in this Trip will be brought in King County Superior Court in Washington State and will be governed by Washington law.
  5. Use of image: In the event that I am photographed or videotaped while participating in this activity, I agree that the photo or videotape may be used for promotional or educational materials specific to the Mountains to Sound Greenway Trust or any of their partners or sponsoring agencies without compensation.
